About the role

WHAT DOES CUSTOMS & EXCISE LAC MANAGER DO?
The Customs & Excise Manager is responsible for ensuring compliance to Customs and Excise legislation and the implementation of all relevant procedures and controls for LAC Operations and all Bacardi entities in Latam & Caribbean countries, as well as supporting and monitoring all business partners within that territory. Furthermore, this role acts as primary contact for all aspects of customs, excise tax, compliance with legislation, and for review that all required licenses are in place.

ABOUT YOU
You must have a bachelor of Economy, Foreign trade or Laws, desirable with a Master degree related with the analisys of economics laws.
Minimum of 3 years of relevant experience in a senior Customs and Excise role within a Global Organisation.
English business fluent, other languages desirable

Responsibilities

WITH OUR CONSUMER AT THE HEART, YOUR KEY RESPONSIBILITIES WILL BE TO:

  • Develop, implement and maintain a clear governance and a control process to ensure compliance in all Customs & Excise areas.
  • Ensure compliance with relevant regulations: Customs, Excise duty, tax stamps (local and received from abroad)
  • Maintain an appropriate control environment to ensure all declarations are made within mandatory deadlines, and all agreed internal controls are followed (including excise related Awareness of C&E across the business - ensure that the importance of C&E is understood across the business and facilitate training to support this.
  • Maintain a positive working relationship with Customs and Excise authorities, auditors (for audits results and follow-up).
  • Maintain review procedures to ensure high quality submissions are made to Customs and Excise authorities - Duties calculation/ Customs import & export declarations/ Excise declarations.
  • Be recognized as the key technical and legislative resource on Excise and Customs for C&E team, logistics, finance teams and wider business, providing legislative updates and having the ability to answer related queries.
  • Coordination of Customs and tax assessments/disputes and introduction of relevant measures to ameliorate risks.
  • Reviewing SOP's and ensuring that Customs and Excise procedure and controls are embedded, with references to SAP and other systems where relevant.
  • Be a recognized system SME (Subject Matter Expert) – drive and sponsor any required enhancements and improvements.
  • Ensure processes are in place (with backup) and staff trained to execute and perform C&E related responsibilities, including: ED Module/any other C&E administration tool, or administrative controls – daily, weekly, monthly, annual as required.
  • Timely preparation, review and submission of all required declarations.
  • Correct application of local commodity codes and Excise duty product codes for all goods imported, exported, produced/bottled and all goods released for consumption in the local market.
  • Implementation of preference and origin checks.
  • Handling of the destruction of write-offs and products subject to excise, in line with local regulations.
  • Preparation of application, payment and withdraw of local strip stamps and strip stamps received from other countries to be applied at the local plant.
  • Preparation and validation by competent authority of any document requested by the consignee (certificate of origin, delivery notes, certificate of analysis and other declarations).
  • Process of following up on irregularities during the transport of products subject to excise and bonded (duty suspended) goods, recoveries of any duties paid.
  • Preparation of export and/or any interstater accompanying documents for shipment to/from/within LAC countries and for national transfer order under excises/customs duty suspension arrangement. 
  • Maintain with support of logistics team a list of open export/national documentation at each month end, by number, age and value (if payment has been enforced).
  • Customs bonded warehouse and Tax warehouse accounting and inventory control.
  • Import clearance and compliance with local regulations.

KNOWLEDGE EXPERTISE
  • Foreign Trade regulation and Excise regulation in LAC.
  • The 3 main customs areas. Experience of Customs in the key areas of Commodity/ HS Codification, Valuation, and Origin (preferential and non-preferential), and the impact of these pillars on business flows.
  • AEO/CT-PAT experience.
  • LAC and/or local spirits and wines production regulations.
  • Excise legislation – regional and market specific.
  • National law and VAT regulations.
  • Customs authorities and procedures.
  • Simplified customs processes like authorized exporter/importer/ consignor.
  • Procedures relating to transit, exportation and summary declaration.
  • Origin of goods- and preferential rights.
  • SAP.
